39) Pertemps:- Data Protection Issue

4th Feb 2014

Pertemps visit.

Spoke to adviser at pertemps with regard to data protection act.

She told me that pertemps no longer have any access to my data, and that it is has now been passed to be retained by the ESG (Employment Skills Group) who will store it for a certain amount of time, and i'm hopefully reliably informed ;) not pass it to anyone else.

With regards to the National Careers Service, apparently a member of this organisation was in the Pertemps facility a while back, the adviser mentioned that the National Careers service was sub-contracted by Pertemps, this was not made clear to me as far as i can recall, and i allegedly signed something with regard to data protection. However i cannot remember doing this, and if i did indeed sign this, then the signature and consent that was obtained was done so both under Duress (threat of sanction from jobcentre) and without informed consent, which means any data that was taken shall ultimately be rendered null and void. I will endeavour to find out what information they hold, and what has been passed elsewhere, before i ask that it is destroyed.

So far i have discovered that my data, from the unlawfully obtained offset has been passed to pertemps, who then had a sub-contract with the national careers service, and was passed to them via this "contract".

The national careers service are part of the www.cswp.org.uk group. Who i will now try to find further information on.

As aforementioned any such consent obtained with regard to the work programme and ultimately the national careers service (www.cswp.org.uk) (and any subsidiaries or sub-contractors of these) was obtained under duress, and thus unlawfully obtained.

Next port of call will be the National Careers service to find out if they have passed my data to any sub-contractors, as this seems to be a legislative loop-hole with regard to data-protection, if pertemps had a national careers service operative in their ranks, as far as i can remember i was unaware this was so, or that they were a member of a separate organisation to pertemps. (Which possibly they technically weren't if pertemps sub-contracted to the national careers service).

Nevertheless i shall continue digging, to find out how many organisations have access to my data, through the mandatory work programme requirement.

Nothing like a spot of investigative journalism, whilst one is unemployed i guess ;)
